1. Agreement to Terms
By accessing or using AutomationKit (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use of the Service immediately. These Terms apply to all visitors, users, and entities who access or interact with our platform in any capacity.
2. Description of Service
AutomationKit provides AI-powered automation tools including but not limited to appointment setting, messaging automation, CRM integrations, lead handling, workflow automation, objection-handling conversations, and calendar booking functionalities. The Service may evolve over time as we add new features, remove outdated functionality, or improve performance.
3. User Accounts
To access certain features, you must create an account and provide accurate information. You are responsible for safeguarding your login credentials and any activity under your account. We are not liable for loss resulting from unauthorized use. You agree to notify us immediately if you believe your account has been compromised.
4. Payment & Billing
The Service operates on subscription plans, setup fees, and recurring billing. Charges renew automatically unless canceled prior to the billing cycle. All payments are final and non-refundable except where required by law. We may adjust pricing with a minimum of 30 days notice to active users.
Failure to complete payment may result in suspension or termination of access to the Service.
5. Service Availability & Updates
We aim to maintain uptime and stable performance; however, we do not guarantee uninterrupted access. Maintenance, feature changes, system upgrades, or external provider outages may affect availability. We reserve the right to modify, pause, or discontinue features at any time with or without notice.
6. User Conduct & Responsibilities
You agree to use the Service responsibly and in compliance with all applicable laws. You must not:
- Use the Service for spam, harassment, fraud, or misleading outreach.
- Upload or store private client data without proper consent.
- Attempt to reverse engineer, bypass security, or disrupt system integrity.
- Use AI conversations in a manner that violates carrier/TCPA regulations.
- Misrepresent your identity or the purpose of your communication.
You are responsible for ensuring your use of AI messaging complies with SMS, email, telemarketing, and consent regulations in your region.
7. Intellectual Property
All content, branding, code, AI systems, user interface elements, and proprietary technologies are owned by AutomationKit and protected under copyright and intellectual property laws. You are granted a revocable, non-exclusive license to use the Service for business purposes only.
8. Data Processing & Privacy
Use of the Service is also governed by our Privacy Policy. By using AutomationKit, you consent to the collection and processing of information as outlined in that policy. Lead data, client records, and messaging content you upload remain your property—we store and process it strictly for Service use.
You are responsible for obtaining consent from contacts prior to messaging or importing them.
9. Disclaimer of Warranties
The Service is provided "as-is" and "as available" without warranties of any kind. We do not guarantee sales outcomes, lead conversions, messaging accuracy, or AI output correctness. You assume all risk associated with using automated messaging and CRM workflows.
10. Limitation of Liability
To the fullest extent permitted by law, AutomationKit is not liable for damages—direct or indirect— including loss of revenue, data, leads, opportunities, or business resulting from use of the Service. Our total liability shall not exceed the amount paid to us in the 60 days preceding the claim.
11. Termination of Use
We may suspend or terminate access at our discretion if you violate these Terms or engage in harmful use. Upon termination, your right to use the Service ends immediately. Data deletion requests can be submitted in writing to our support team.
12. Changes to Terms
We may update or revise these Terms periodically to reflect product improvements or legal compliance. Updates become effective once posted. Continued use of the Service indicates acceptance of the new Terms.
